Terms of Service

Welcome to Purple.tips, a platform operated by AMSYPER Systems, Inc., based in the Philippines. By accessing or using Purple.tips (the "Platform"), you agree to comply with and be bound by the following Terms of Service (the "Terms"). Please read these Terms carefully before using the Platform. If you do not agree with these Terms, you may not use the Platform.

1. Definitions

  • 1.1. "Platform" refers to the Purple.tips website and any related services or applications.
  • 1.2. "Content Creator" refers to any individual or entity that uploads, publishes, or shares content on the Platform for public or private access.
  • 1.3. "User" refers to any individual or entity accessing or using the Platform.
  • 1.4. "Commission" refers to the 10% fee deducted by AMSYPER Systems, Inc. from the total income earned by Content Creators through the Platform.

2. Eligibility

  • 2.1. To use the Platform, you must be at least 18 years old or meet the legal age of majority in your jurisdiction.
  • 2.2. By registering for an account, you represent and warrant that all information provided is accurate, current, and complete.

3. Account Registration

  • 3.1. Users and Content Creators must create an account to access certain features of the Platform.
  • 3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
  • 3.3. AMSYPER Systems, Inc. reserves the right to suspend or terminate accounts for violations of these Terms or for other reasons at its discretion.

4. Content Creation and Usage

  • 4.1. Content Creators retain ownership of their content but grant AMSYPER Systems, Inc. a worldwide, non-exclusive, royalty-free license to use, display, distribute, and promote the content on the Platform.
  • 4.2. Content shared on the Platform must comply with all applicable laws and must not include any illegal, harmful, or inappropriate material.
  • 4.3. AMSYPER Systems, Inc. reserves the right to remove or disable access to any content that violates these Terms or is deemed inappropriate.

5. Commission and Payments

  • 5.1. AMSYPER Systems, Inc. will deduct a 10% commission from the total income earned by Content Creators on the Platform.
  • 5.2. Content Creators are responsible for all applicable taxes on their earnings.
  • 5.3. Payments to Content Creators will be processed in accordance with the payment schedule and methods specified on the Platform.
  • 5.4. In case of disputes regarding earnings, Content Creators must notify AMSYPER Systems, Inc. within thirty (30) days of the disputed transaction.

6. User Conduct

  • 6.1. Users and Content Creators agree to use the Platform lawfully and respectfully, without engaging in any harmful or disruptive activities.
  • 6.2. Users must not:
  • 6.2.1. Harass, threaten, or defame other users or Content Creators.
  • 6.2.2. Post or distribute spam, phishing content, or malware.
  • 6.2.3. Attempt to bypass or breach the security of the Platform.

7. Intellectual Property

  • 7.1. All trademarks, logos, and other intellectual property of AMSYPER Systems, Inc. and Purple.tips remain the exclusive property of AMSYPER Systems, Inc.
  • 7.2. Unauthorized use of AMSYPER Systems, Inc.’s intellectual property is prohibited.

8. Limitation of Liability

  • 8.1. AMSYPER Systems, Inc. provides the Platform "as is" and does not guarantee uninterrupted or error-free operation.
  • 8.2. The Purple.tips or AMSYPER Systems, Inc. is not liable for any loss of data, media, transactions, or money due to technical issues such as network outage, poor connection, or any technical, programming, or network-related issue.
  • 8.3. AMSYPER Systems, Inc. is not liable for any damages arising from the use or inability to use the Platform, including loss of income, data, or reputation.

9. Indemnification

  • 9.1. Users and Content Creators agree to indemnify and hold AMSYPER Systems, Inc. harmless from any claims, damages, or expenses arising from their use of the Platform or violation of these Terms.

10. Modifications to Terms

  • 10.1. AMSYPER Systems, Inc. reserves the right to modify these Terms at any time. Changes will be effective upon posting on the Platform.
  • 10.2. Continued use of the Platform after modifications constitutes acceptance of the updated Terms.

11. Governing Law

  • 11.1. These Terms are governed by the laws of the Republic of the Philippines.
  • 11.2. As a Content Creator under Purple.tips, you agree to abide by these Terms.
  • 11.3. Any disputes arising under these Terms will be resolved exclusively in the courts of Davao City, Philippines.

12. Tax Withholding and Reporting

  • 12.1. Tax Withholding: AMSYPER Systems, Inc. is generally not required to withhold taxes on payments to Content Creators in jurisdictions such as the U.S., U.K., Canada, Australia, Germany, Brazil, Mexico, France, and Singapore. However, Content Creators are responsible for reporting their income to their respective tax authorities and paying any applicable taxes.
  • 12.2. Information Reporting: AMSYPER Systems, Inc. may be required to provide information to tax authorities regarding payments to Content Creators, including filing necessary forms such as Form 1099-NEC (U.S.), or equivalent, if certain thresholds are met.
  • 12.3. Content Creators are encouraged to consult with a tax professional to determine their specific tax obligations based on their jurisdiction.

13. Digital Wallet

  • 13.1. Users may reload their Purple.tips Digital Wallet to facilitate transactions on the Platform.
  • 13.2. Users agree to cover any transaction fees associated with reloading their Digital Wallet.
  • 13.3. Reloaded amounts in the Digital Wallet are non-refundable.
  • 13.4. Users are encouraged to review all details before completing wallet reload transactions.
